Terms and conditions

§ 1 Scope

These general terms and conditions (T&Cs) apply to all contracts that a customer concludes with Custom-Automotive GmbH, Industriestraße 22, 63517 Rodenbach, Germany (hereinafter “we”), via the online shop KORNDEX. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB, German Civil Code). A trader is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession (§ 14 BGB).

We do not recognise any conflicting terms of the customer unless we have expressly agreed to their validity in writing.

§ 2 Conclusion of contract

The presentation of products in the shop is not a binding offer but an invitation to place an order. By clicking the order button at checkout, the customer submits a binding offer. Before submitting, the customer can check and correct their entries. We confirm receipt of the order by email without delay; this confirmation does not yet constitute acceptance. The contract is concluded when we accept the order with an order confirmation by email or dispatch the goods – but no later than five working days after the order, unless we have rejected it by then.

We store the text of the contract and send it to the customer by email together with these T&Cs with the order confirmation. The language of the contract is German.

§ 3 Prices and shipping costs

All prices are in euros and include statutory VAT. Shipping costs are added and are shown at checkout before the order is placed; details are on the page “Shipping & payment”. For traders with a business account, the terms agreed there apply.

§ 4 Payment

Payment is made using the payment methods offered at checkout. For payment in advance, the amount is due within seven days of conclusion of the contract; for payment service providers, their terms apply. We offer payment by invoice to traders with a business account; the invoice is payable within 14 days without deduction unless otherwise agreed.

§ 5 Delivery

We deliver within Germany unless further countries are offered at checkout. We usually dispatch goods in stock within 1–2 working days of receipt of payment or conclusion of the contract; the expected delivery time is shown on the product and at checkout. If an item is not available, we will inform you without delay and refund any payments already made. For consumers, the risk of accidental loss passes on handover of the goods; for traders, on handover to the carrier.

§ 6 Retention of title

The goods remain our property until paid for in full. For traders, they remain our property until all claims arising from the ongoing business relationship have been settled.

§ 7 Right of withdrawal

Consumers have a statutory right of withdrawal. The details – deadline, exercise, consequences and exclusions – are set out in the withdrawal policy.

§ 8 Warranty

The statutory warranty rights apply. For traders, the warranty period is one year from delivery of the goods; this does not apply to claims for damages due to injury to life, body or health, or in cases of intent or gross negligence. Traders must inspect the goods without delay and report obvious defects within 14 days (§ 377 HGB, German Commercial Code).

Information on grit, dimensions, service life and suitability are descriptions, not guarantees, unless expressly designated as a guarantee. Recommendations on grits and applications (guides, finder) are non-binding advice; the customer checks suitability for the specific use.

§ 9 Liability

We are liable without limitation for intent and gross negligence, under the Product Liability Act and for injury to life, body or health. In cases of simple negligence, we are only liable for breach of an essential contractual obligation (cardinal obligation), and limited to the foreseeable damage typical of the contract. Otherwise, liability is excluded.

§ 10 Business account and volume discounts

Traders can apply for a business account. The prices, discounts and payment terms agreed there apply to orders placed via the business account and to that extent replace the prices in the shop. We may decline a business account or suspend it in the event of late payment.

§ 11 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the state in which the consumer has their habitual residence. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Rodenbach. Should individual provisions be invalid, the remainder of the contract remains valid.
